Terms and Conditions

Please read these Terms of Use (“Terms”) carefully. These Terms form a binding agreement between you and Mockupin.com, operated by its parent, subsidiaries, and affiliates (“Mockupin.com”, “we”, “us”, or “our”), with its principal office at Malang, Indonesia. “You” or “your” refers to you personally or, if you use the Website, Platform, or Services on behalf of a legal entity, that entity, and you represent and warrant that you have the authority to bind that entity to these Terms.

By accessing or using the Website, Platform, or Services, you agree to these Terms and all documents incorporated by reference (including our Privacy Policy and applicable Licenses).

YOUR USE OF THE WEBSITE, PLATFORM, OR SERVICES IS CONDITIONED ON YOUR ACCEPTANCE OF THESE TERMS. If you do not understand or agree, do not use the Website, Platform, or Services. For questions, contact hello@mockupin.com.

For convenience only, these Terms are organized into four parts (you are bound by all parts that apply):

• Part A – Terms applicable to all users
• Part B – Additional terms for Members
• Part C – Additional terms for Authors
• Part D – Additional terms for Affiliates

Part A — Terms Applicable to All Users

Definitions

• Affiliate: A Member who has accepted Part D and refers new customers to the Platform.
• Author: A Member who has accepted Part C and uploads Products to the Platform.
• Creative Store Item: Files (e.g., mockups, templates, photos, 3D objects, video, audio, add-ons, UI/UX kits) made available in Creative Store.
• Creative Fonts Item: Typeface/font files made available in Creative Fonts.
• Creative Items: Collectively, Creative Store Items and Creative Fonts Items.
• Materials: All content making up the Platform (excluding Products and Previews), including text, graphics, layout, software, logos, photos, audio/video, and interactive content.
• Member: A registered account holder who has accepted Part B (includes Authors and Affiliates).
• Mockup: A PSD/TIFF layered file and/or 3D model designed to integrate user imagery.
• Image 360: Ordered raster sequences (PNG/MOV) from which frames may be extracted.
• Platform: The Website and any apps, features, and devices we provide to deliver the Services and Products.
• PNG Image: A single static PNG asset (with/without transparency).
• Preview: Low-resolution single-layer preview images, specs, and descriptions that accompany a Product.
• Product: Any Mockup, Creative Item, Image 360, or PNG Image (and its Preview).
• Service: Making Products available via the Platform and any related services.
• Website: Our site at https://mockupin.com and all subdomains/subdirectories.

“Including,” “e.g.,” and similar terms mean “including without limitation.” Singular includes plural and vice versa; “and/or” is used as appropriate.

Changes to These Terms

We may amend these Terms by posting an updated version at https://mockupin.com/terms and, for Members, notifying by email (if not opted out). Your continued use signifies acceptance. If you disagree, discontinue use and, if applicable, close your account.

Eligibility

The Platform is intended for a global audience but may not be available in all jurisdictions. You are responsible for complying with local laws. The Website/Platform/Service is not intended for children below the age of majority without verified parental/guardian consent. Internet access is required and at your cost.

Intellectual Property

Products and Materials are protected by applicable intellectual-property laws. We or our licensors retain all rights to the Materials and (unless stated otherwise) Authors retain rights to Products. Subject to these Terms and an applicable License, we grant you a non-exclusive, non-transferable, royalty-free right to use Materials/Products as permitted.

All third-party trademarks and content remain the property of their owners. “Mockupin.com” names, logos, and marks are our trademarks; do not use them without written permission.

Permitted Use

Unless expressly allowed by these Terms or a License, you may not use Products, Previews, or Materials.

• You may view Previews via the Platform only for informational evaluation prior to purchase, personally, non-commercially, and in compliance with these Terms.
• Except where a “download” link is provided, do not download, copy, redistribute, modify, publish, broadcast, display, sell, stream-capture, or create derivative works from Products, Previews, or Materials.
• Do not remove/alter copyright notices or circumvent DRM/access controls.

No Unlawful or Prohibited Use

You agree not to: infringe rights; access via unauthorized means; impersonate; solicit Members off-platform to circumvent Mockupin.com; introduce malware; overload/attack our systems; collect personal data contrary to our Privacy Policy; or violate any law or these Terms. We may suspend or terminate access for violations and may report misuse to authorities.

User-Generated Content (UGC)

You are responsible for UGC you submit (e.g., comments/reviews). Do not post unlawful, infringing, obscene, hateful, or otherwise objectionable content or harmful code; do not include prohibited links. You represent you have rights to your UGC and grant Mockupin.com a worldwide, perpetual, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, display, and create derivatives of your UGC in any media, and grant other users a limited license to access and use it via the Platform. Where permitted by law, you waive moral rights in UGC. We may (but are not obligated to) monitor, edit, or remove UGC.

Spam / Unsolicited Communications

Do not harvest Member info or send unsolicited promotions to Members. Unauthorized bulk messages may result in account action. For advertising inquiries, contact business@mockupin.com.

Relationship

These Terms do not create partnership, joint venture, employment, or general agency between you and us. For Products, we often act as Authors’ limited agent solely to facilitate licensing.

Third-Party Links & Ads

Linked sites are provided for convenience; we do not endorse or control them and are not liable for content or practices. Review third-party terms and privacy policies separately.

Disclaimers; Limitation of Liability; Indemnity

AS-IS BASIS. The Website, Platform, Services, Materials, and Products are provided “as is,” “as available,” with all faults, without warranties of any kind (express or implied), including merchantability, fitness, non-infringement, availability, or accuracy.

We do not individually verify each Product. Some items may contain errors or be unsuitable for certain uses. All sales are final except as expressly stated in our refund section.

To the maximum extent permitted by law, in no event will Mockupin.com or its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for indirect, incidental, special, consequential, punitive damages, or lost profits. Our aggregate liability will not exceed the greater of (i) USD $10 or (ii) the amount you paid to us for the specific access giving rise to the claim.

You agree to indemnify and hold harmless Mockupin.com and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your UGC, or your misuse of the Platform/Products.

We may change or discontinue any aspect of the Website, Platform, Services, or Products at any time without liability.

Notice & Takedown (IP / Content Complaints)

We respect intellectual-property rights. Report alleged infringements or unlawful/inappropriate content to hello@mockupin.com with: (1) link/ID of the item; (2) your IP identification; (3) good-faith statement; (4) proof of authority; (5) contact details; and (6) sworn accuracy statement. We will review and act at our discretion, which may include removal.

No Waiver / Severability

Our failure to enforce a provision is not a waiver. If any provision is unenforceable, the remainder remains in effect, and the invalid provision will be replaced by one that most closely reflects the original intent.

Governing Law

These Terms (and any non-excludable consumer guarantees) are governed by the laws of the Republic of Indonesia. Except as required by non-waivable law, disputes shall be resolved as set out in Arbitration below.

Arbitration

We aim to resolve issues informally. Email hell0@mockupin.com and allow 30 days for resolution. If unresolved, to the maximum extent permitted by law, disputes shall be finally settled by binding arbitration administered by an Indonesian arbitration institution (e.g., BANI) under its rules, by a single arbitrator seated in Malang, Indonesia. Each party bears its own legal fees and shares administrative costs unless the arbitrator allocates otherwise for frivolous claims. Class actions and representative proceedings are waived. If arbitration is found unenforceable for a specific dispute, you submit to the exclusive jurisdiction of courts in Malang, Indonesia.

Enforcement

We may act against violations (warnings, suspension, termination, arbitration, or legal action in an appropriate forum). We are authorized by Authors to enforce their IP rights related to Products.

Part B — Additional Terms for Members

Membership & Accounts

To download Products, register an account. You are responsible for all activity under your account; keep credentials secure and accurate. We may require you to change display names/avatars and may reference your brand/name as our client or showcase derivative works you created (as permitted by law and applicable License). You may terminate at hello@mockupin.com; we may suspend/terminate for violations or undue system load.

Purchasing Products

Except for free items we may offer, access to Products requires payment via available methods. You are responsible for taxes and currency conversion where applicable.

Handling Fees & Credits

We may charge a handling fee for some payment methods. If we offer Credits (our internal currency), you can purchase them (e.g., minimum amounts may apply) and use them for Products; Credits are non-refundable, non-redeemable for cash, and may expire after 12 months unless refreshed by new purchases.

Membership Plans

We may offer discounted Mockupin Memberships that provide benefits/discounts for future purchases, subject to plan terms. Discounts cannot be stacked; multi-user terms apply as specified.

Wishlist Requests & Custom Service Projects

We may accept community/Wishlist requests, but fulfillment is not guaranteed. For Custom Service Projects, we quote scope/price/timeframe; prepayment may be required and held until completion. Authors may showcase custom work in portfolios unless exclusivity is purchased.

Refunds

All sales are final. Refunds are only considered if the delivered Product is materially different from its Preview. Contact hello@mockupin.com first (do not open a payment dispute). Price changes after purchase do not qualify for refunds. Unused Credits are not refunded.

License to Use Products (Overview)

Purchasing grants a License, not ownership. Except where Mockupin.com is the rights holder, the Author is the licensor and retains IP ownership. License terms presented at checkout govern your use; if they conflict with these Terms, the License controls.

You must not remove rights notices or circumvent protections. You agree to abide by all License limits; violations constitute breach of these Terms.

License Types – Mockups & Creative Items

We offer Standard and Enhanced Licenses (scope differs by usage limits, copies/impressions, project budget, headcount, support level, etc.). Both are worldwide, perpetual, non-exclusive, royalty-free and permit creating derivative works for your (or your clients’) projects, but you may not resell, sublicense, share, or redistribute the original files in ways that compete with our Platform.

License — Images 360 & PNG Images

Royalty-free license: worldwide, perpetual, non-exclusive, non-transferable right to use, modify, and reproduce for:

• digital (websites, ads, social, apps, e-pubs, video platforms);
• print (end-products, POS, OOH, magazines, books);
• audiovisual productions; and
• personal non-commercial use.
  You may not resell, sublicense, share, or redistribute source files/frames in a way that competes with the Platform.

Editorial Use Only

Items marked “Editorial Use Only” may include people/property/brands without necessary releases. Unless you secure additional permissions, use is limited to descriptive/editorial contexts (e.g., news, commentary) and not for product packaging, service materials, ads, or endorsements, and not in defamatory/deceptive contexts.

Free Trial / Demo Items

We may offer Demo Items for personal, non-commercial testing only. You may not charge fees, advertise with, upload as website assets, resell, re-license, or sublicense Demo Items.

Part C — Additional Terms for Authors

Authors must own or have rights to all uploaded content and grant Mockupin.com the necessary licenses to host, display, market, and sell Products. Authors remain responsible for accuracy, quality, and legality of their Products and agree to our payout, taxation, and anti-fraud policies. We may moderate, remove, or refuse items at our discretion.

Part D — Additional Terms for Affiliates

Affiliates who accept these terms may promote the Platform under our Affiliate Program rules. Commissions, attribution windows, payout thresholds, and prohibited practices are defined in the program documentation. Self-referrals, trademark bidding, coupon/extension hijacking, and deceptive practices are prohibited.

Communications

We primarily communicate by email. Keep your email current and ensure our messages are not blocked by spam filters. We are not liable for missed communications.
